| 21 липня під час онлайн-конференції відбулася презентація посібника «Співробітництво територіальних громад у сфері адміністративних послуг», розробленого експертами Програми ЄС «U-LEAD з Європою». Посібник містить багато прикладів міжмуніципальної співпраці (ММС) у сфері адмінпослуг, пояснює юридичні тонкощі різних форм ММС та містить зразки договорів. Він буде корисним для всіх громад, які прагнуть вдосконалити доступ мешканців до адмінпослуг. «Співробітництво громад – це можливості, які ще кілька років тому були недоступні місцевому самоврядуванню, а зараз – набирають популярності. Це ефективний та доступний інструмент для сталого розвитку потенціалу та ресурсів громад України», зазначив В'ячеслав Негода, заступник міністра розвитку громад та територій України під час вітального слова. Людмила Рабчинська, заступник Міністра цифрової трансформації України, також привітала учасників конференції та додала: «Я впевнена, що укладення договорів міжмуніципального співробітництва допоможе нашим громадам зробити послуги доступнішими та якіснішими, і разом ми зможемо досягти більшого та допомогти один одному. Тому я неймовірно вдячна U-LEAD за те, що вони розробили такий чудовий посібник, і закликаю громади поширювати його серед своїх співробітників. Також, хочу зазначити, що зокрема для великих територіальних громад неймовірно актуальним є питання створення віддалених робочих місць саме в тих населених пунктах, які знаходяться на відстані 7-14 км від центру громади».
Інструмент співробітництва громад з'явився у 2014 році, з часу прийняття Закону «Про співробітництво територіальних громад». Але його активне використання почалося з процесом передачі повноважень від центральної влади на місця. Співробітництво територіальних громад дозволяє їм об'єднувати зусилля та ресурси для досягнення ліпших результатів. Така синергія корисна для розвитку адміністративних послуг, адже кожна громада, що бере участь у співробітництві, отримує вигоду: хтось економить кошти чи інші ресурси, використовуючи «потужності» сусідньої громади, а хтось отримує додаткові надходження до місцевого бюджету за рахунок оплати відповідних послуг. При цьому споживач послуги своєчасно одержує високоякісну послугу там, де це найзручніше для нього, й у комфортних умовах.
«Реформа децентралізації, що успішно здійснюється в Україні за підтримки Європейського Союзу, дала місцевому самоврядуванню широкі повноваження, завдяки яким громади самостійно можуть організувати діяльність багатьох процесів, включно з наданням послуг. Співробітництво територіальних громад є інструментом, який стане у нагоді кожній громаді, яка бажає досягти сталого розвитку та благополуччя всіх мешканців. Адже завдяки партнерству громади можуть поєднати зусилля та ресурси у досягненні спільних цілей та вирішенні актуальних завдань, серед яких на передовій – надання якісних та доступних послуг мешканцям», наголосила Наталія Старостенко, керівник сектору місцевого розвитку Представництва ЄС в Україні, під час вітального слова до учасників заходу. Програма «U-LEAD з Європою» є одним з драйверів впровадження ММС у сфері адмінпослуг: 72 громади отримують допомогу Програми у створенні та модернізації ЦНАП завдяки партнерським договорам з іншими громадами. Загалом, на час підготовки Посібника, з 597 зареєстрованих договорів ММС в усіх сферах – 130 у сфері адмінпослуг (22%). Віра Козіна, експерт з юридичних питань та одна з ключових авторів посібника, під час презентації дала громадам низку порад та практичних рекомендацій щодо правильного складання договорів ММС: - Пишіть чітко, але без надмірної деталізації, не забувайте про специфіку предмету договору
- Визначайте «ролі» – вже на старті має бути розуміння завдань, які виконує кожний з учасників, якісна координація – опис завдань
- Узгоджуйте регламент діяльності (зокрема - інформаційні та технологічні картки, проводимо спільні навчання та консультації)
- Узгоджуйте фінансово-майнові аспекти «на березі» (не забувайте про правовий статус майна)
- Закон дає широке поле для творчості, але фантазуйте обережно.
«Партнерство – це та парадигма, яка лежить в основі стійкого розвитку, як на рівні невеликих спільнот, так і на рівні країн та регіонів. The manual contains many examples of inter-municipal cooperation (IMC) in the field of administrative services, explains the legal nuances of different forms of IMC and provides sample agreements. It will be useful for all hromadas willing to improve residents' access to administrative services. "Cooperation of hromadas provides opportunities which had been unavailable to local self-government authorities several years ago and are currently gaining more and more popularity. This is an efficient and accessible tool for sustainable capacity building and resources of the Ukrainian hromadas", said Viacheslav Nehoda, Deputy Minister for Hromadas and Territories Development of Ukraine during his opening speech. Liudmyla Rabchynska, Deputy Minister of Digital Transformation of Ukraine, also greeted the conference participants and added: "I am confident that inter-municipal cooperation will help our hromadas make services more accessible and better. Together we can achieve more and help each other. That is why I am so grateful to U-LEAD for developing such a great manual, and I encourage hromadas to distribute it among their employees. Also, I want to note that for the large territorial hromadas, creation of remote workplaces is especially relevant in those settlements that are located at 7-14 km distance from the hromada centre". The inter-municipal cooperation instrument appeared in 2014, after adoption of the Law "On Cooperation of Hromadas". However, it became actively used with the delegation of powers from central to local level. An inter-municipal cooperation a llows hromadas to combine efforts and resources to achieve better results. Such synergy is useful for the development of administrative services, as each participating hromada will benefit: one will save money or other resources by using the "capacity" of the neighboring hromada, and another will receive additional revenues to the local budget from services fees. Thus, the customers will receive high-quality service in due time in comfortable conditions and in the convenient place. "The decentralization reform, which is being successfully implemented in Ukraine with the support of the European Union, has given wide powers to local self-government authorities, through which the hromadas can independently arrange many activities, including the delivery of services. The hromada cooperation is a tool that will be useful for every hromada willing to achieve sustainable development and well-being of all residents. After all, thanks to the partnership, the hromadas can combine efforts and resources in achieving common goals and solving relevant tasks, the main of which is the delivery of high-quality and affordable services to residents", emphasized Natalia Starostenko, Head of Local Development Sector at the European Union Delegation to Ukraine. The U-LEAD with Europe Programme is one of the drivers of IMC implementation in the sphere of administrative services: 72 hromadas are supported by the Programme in the establishment and modernisation of ASCs through partnership agreements with other hromadas. In total, at the time of preparation of the Manual, 130 out of 597 IMC agreements were registered in the sphere of administrative services (22%). During the presentation, Vira Kozina, a legal expert and one of the co-authors of the Manual, gave a few tips and practical recommendations to the hromadas on how to properly draft IMC agreements: • Write clearly, without excessive detail, do not forget about the specifics of the subject of the agreement • Define "roles". Already from the start it should be understood what tasks are performed by each of the participants, quality coordination - a description of tasks • Agree on the rules and procedures (in particular - information and technology cards, joint training, and consultations) • Reconcile financial and property aspects (do not forget about the legal status of the property) • The law gives a wide field for creativity but fantasize carefully. "The partnership is a paradigm underpinning sustainable development both at the level of small hromadas, and at the level of countries and regions. I am sure that the Manual will be useful for the hromadas, as it contains the most complete information about the partnership in the sphere of administrative services in Ukraine", said Susanna Dellans, Sida Programme Director of U-LEAD with Europe.
